On April 1, 2019, automatic adjustments will be made to the dollar amounts stated in various provisions of the Bankruptcy Code and one provision of Title 28. Seven Official Bankruptcy Forms (106C, 107, 122A-2, 122C-2, 201, 207, and 410) will be amended to reflect these adjusted dollar amounts, and one set of instructions for a Director’s Form which includes a dollar amount. . The adjustments will become effective April 1, 2019.
If the correct official form is not used beginning on April 1, 2019, the bankruptcy court will enter a Notice Directing the Filing of the correct Official Form. If the correct official form is not filed within the time prescribed, the court may strike the pleading or set the case for hearing.
Section 104 of the Code provides that the Judicial Conference make the adjustments, which are calculated at three-year intervals on the basis of the change in the Consumer Price Index for the most recent three-year period ending immediately before the year in which the adjustment is made and rounded to the nearest $25.
