THIRTY DAY NOTICE AND PUBLIC COMMENT PERIOD
CONCERNING CHAPTER 13 PLAN FORM

A proposed amendment to Federal Rule of Bankruptcy Procedure 3015 requires the use of a national chapter 13 plan form unless a district adopts a local plan form that meets the requirements of new proposed Federal Rule of Bankruptcy Procedure 3015.1.  The United States Bankruptcy Court for the Eastern District of Oklahoma has determined that it will opt out of the national chapter 13 plan form. After considering input from the Chapter 13 Trustees for the Northern and Eastern Districts of Oklahoma, Judge Cornish of the United States Bankruptcy Court for the Eastern District of Oklahoma has approved for publication, for a thirty‑day public comment period, a draft mandatory Chapter 13 Plan (the "Chapter 13 Plan"), a copy of which accompanies this notice.  (Judges of the United States Bankruptcy Court for the Northern District of Oklahoma have also approved this form for publication and public comment.)  Both the Northern and Eastern Districts of Oklahoma are opting out of the national chapter 13 plan form and intend to adopt this Chapter 13 Plan.  

The anticipated effective date of amended rule 3015 and new rule 3015.1 is December 1, 2017, which will also serve as the effective date to begin use of the Chapter 13 Plan in the Eastern District of Oklahoma. Beginning December 1, 2017, use of the new Chapter 13 Plan will be mandatory.

Comments regarding the Chapter 13 Plan may be submitted on or before September 15, 2017 by email to chapter13plan@okeb.uscourts.gov , or by mail to Clerk of Court, U.S. Bankruptcy Court, Eastern District of Oklahoma, P.O. Box 1347, Okmulgee, OK 74447.  Each comment must identify the specific text or provision being addressed and must be accompanied by any supporting documentation.

The proposed chapter 13 plan form is subject to further modification prior to final approval as a result of timely public comments and further judicial review.
