NOTICE TO ATTORNEYS
REGARDING CHAPTER 13 PLAN AND SUMMARY
On September 1, 2011, the Oklahoma Eastern Bankruptcy Court will begin a new procedure regarding Chapter 13 Plan and Summary. Pursuant to Rule 3015(d) the Plan or Summary of the Plan shall be included with each notice of the hearing on confirmation mailed pursuant to Rule 2002. Our Local Rules state that if the debtor files the Plan with the Petition, the Plan will be mailed with the Notice of the 341 Meeting, which includes the date of the confirmation hearing. However, in an effort to curb the high costs of noticing, our court will notice only the Summary of the Plan rather than the entire Plan.
There will also be a notice that will be sent with the Summary informing recipients that they may view the Plan form on the court’s website or contact the Chapter 13 Trustee or Debtors’ attorney if they would like to have a copy of the filed Plan. This notice also provides information about objections, temporary restraining orders and waivers. We have attached a copy of the notice that will be accompanying the Summary for your review. We will continue our prior rule that if you file your Plan and Summary with the Petition, then the Summary will be mailed out by the court. If you fail to file it with the Petition, then it will be the debtors’ responsibility, through their attorney, to mail out the Summary of the Plan to all creditors.
Beginning September 1st, all attorneys should file their Plan Summary as a separate document from the Plan. We will have a new event in CM/ECF entitled Chapter 13 Plan Summary and ask that you file it utilizing this event. When filing, go to the Plan category under Bankruptcy and then to the Chapter 13 Plan Summary event.
