Motion Procedure for the Eastern District of Oklahoma
FOR ELECTRONIC CASE FILING
The following instructions will guide you through the process of filing and docketing all Motions in the Eastern District of Oklahoma.
Step 1 Prepare your Motion in WordPerfect or Microsoft Word and
Save as a PDF document. (See: specific instructions on how to
prepare a PDF Document.) Step 2 Prepare your Order in compliance with E-Order Instructions. The
top margin on the first page must be four inches. The last line in the
proposed order must be three pound symbols(###), centered in the middle
of the line to indicate the end of the order. The signature line for the judge
is no longer necessary. The judge will electronically sign the document in
the blank space provided by the top margin on the first page. The fonts
used with Adobe Acrobat Writer version 3 or 4 must be Courier,
Helvetica, or Times New Roman (Regular, bold, italic, and bold italic).
The fonts used with Adobe Acrobat Writer version 5 must be Arial,
Courier, or Times New Roman (Regular, bold, italic, and bold italic) Step 3 Go to the Court’s web page: www.okeb.uscourts.gov and
click on Hearing Dates then click on the correct chapter drop down
list, click on the correct motion, if the Motion is listed, if the Motion
is not listed click on General Motions, then click on the Get a Hearing Box Step 4 Obtain the Objection Deadline, Hearing Date, and Hearing
Location from the Web page then Click on the Form 20 link. Fill in
the Form 20 with your information and save as a PDF Document.
Make certain to sign the notice utilizing the s/your printed name. We have several Local form 20's listed below with explanation. Local Form 20A Notice of Motion Notice of Deadline to File
Objection to Motion and Notice of Hearing If Objection is Filed.
We have 2 Bankruptcy Form 20A Forms. 1) For use for a Telephonic Hearing 2)
For use when the Hearing is Held in the Courtroom. We Also have a Local Form 20A for use with an Adversary
Proceeding. Local Form 20B Notice of Objection to Claim or Exemption Notice
of Deadline to File Response to Objection to Claim or Exemption
and Notice of Hearing Local Form 20C Notice of Motion Notice of Deadline to File
Objection to Motion and Notice of Hearing Local Form 20D Notice of Hearing and Fixing Time for Filing
Complaint Under 11 U.S.C. Sec. 523 (c) Motion for Hardship
Discharge in Chapter 13 Step 6 Login to CM/ECF, file the Motion under the heading
BANKRUPTCY OR ADVERSARY, then Motions and attach your
PDF Motion..Your Motion will electronically be mailed to all parties
that have elected to receive electronic notice. Be sure to save your
Notice of Electronic Filing to a PDF to attach to your Certificate of
Mailing. Step 7 Next upload a your Proposed PDF E-Order - Select
Bankruptcy, Order Upload, Select Upload Single, Type in the Case
Number, Type in the Docket Entry Number of the Motion, Or Click
on the next button and choose the Motion category and click next,
choose your Motion click next Choose Hearing Scheduled, for
Hearing Type, Put in the Hearing Date, Browse and Attach your PDF
Order. Step 8 File the Notice of Motion under the heading BANKRUPTCY
then Notices and attach your PDF Notice of Motion. The Notice of
Motion PDF will be electronically mailed to all parties that have
elected to receive electronic notice. Be sure to save your Notice of
Electronic Filing to a PDF to attach to your Certificate of mailing. Step 9 Print your electronic notices. Then mail by U.S. Mail the
paper Motion and the Paper Notice of Motion to any party that did
not receive electronic notice that should have or is required by the
Rules. Prepare a Certificate of Mailing of the stating that you mailed
the Motion and the Notice to the following parties by U.S. Mail and
save as the Document as a PDF document. Step 10 File the Certificate of Mailing containing the attachments of
the Notice of the electronic notice of the filing of the Motion and
Notice of the electronic notice of the filing of the Notice of Motion
and the parties mailed by U.S. mail, under the heading
BANKRUPTCY then Other, Make sure you say Yes to attachments
and attach the Notice of Electronic Filings of the Motion and the
Notice of Electronic Filing of the Notice of Motion to show the court
who received electronic notice of your Motion and your notice. If
you mailed your Motion to the Matrix you may also attach the Matrix
as an attachment. You also have the option of scanning your all of
your attachments with your certificate of mailing, making them one
document. FYI: To print a matrix under the heading REPORTS then Creditor
Mailing Matrix to mail your Motion and your Notice (See: Manual
Reports) or Utilities, Miscellaneous, Mailings, Creditor Mailing
Matrix If no Objection is filed to a Motion where Form 20A is used, the Hearing will be
taken off of the docket without further notice. If an Objection is submitted all
Parties should be prepared to attend the hearing. No further notice of the hearing
will be mailed. If an Objection is submitted untimely the Objection will be stricken. When Form 20B, C, and D are used a hearing will be held irregardless of opposition
or response. Current Docket sheets and Court Calendars will be available 24 hours a day 7 days
