Filing in Person at the Muskogee Office
If you have documents for filing at the clerk’s office, you should come to the court as early as possible. You should arrive no later than 3:30 pm to allow the clerk’s office staff time to complete your filing before the office closes. Arriving later, will allow your filings to be filed but, may not allow time for complete processing. In addition, it would assist the clerk’s office if you would call ahead to ensure the Clerk’s Office is open and inform the court of an approximate time that you will be arriving. It takes approximately 1 hour to file and process a Bankruptcy Petition. Please make sure your filing fee is in the form of a cashier’s check or money order made payable to Clerk, United States Bankruptcy Court in the exact amount. DEBIT AND/OR CREDIT CARDS ARE NOT ACCEPTED. If you are paying in installments, you must file a completed application and submit your first payment with the petition. Whether you file a chapter 7, 11, 12, or 13 case, you start with the same basic set of forms (as outlined below). This page does not discuss filing under chapter 11 or 12 because it is uncommon for debtors to file petitions under these chapters without an attorney (pro se). Additionally, because corporations and partnerships are required to have an attorney represent them, these entities may not file petitions pro se.
