 Required Documents Due with the petition (minimum filing requirements for a Chapter 11):

  • Form 101 Voluntary Petition for Individuals Filing for Bankruptcy (individual) or Form 201 Voluntary Petition for Non-Individuals Filing for Bankruptcy (non-individual)
  •  Filing Fee -See Fee Schedules or

  • Local Form 1007-1(H) Certification of Payment Advice's with attached copies of all payment advices (pay stubs) or other evidence of payment received by the debtor from an employer within 60 days before filing the petition (individual)
  • Form 2030 Disclosure of Compensation of Attorney for Debtor

 Documents due within 14 days after the filing of the schedules:

  • Local Form 4002-1(B) Affidavit and Disclosure of Domestic Support Obligations (individual) THE AFFIDAVIT SHOULD BE MAILED TO THE UNITED STATES TRUSTEE AND NOT FILED WITH THE COURT

 Documents due 7 days before the date first set for the Section 341 meeting of creditors:

  • A copy of the Federal income tax return (or transcript of return) for the most recent tax year ending before filing (individual and non-individual) THE COPIES SHOULD BE MAILED TO THE UNITED STATES TRUSTEE AND NOT FILED WITH THE COURT Local Rule 4002-1(D)

 Documents due 120 day or 180 days after the filing of the petition:

  • Chapter 11 Plan and Disclosure Statement due 120 days
  • Small Business Chapter 11 Plan and Disclosure Statement Due 180 days

 

 Documents due before the last payment is made under the plan and before the discharge can be granted:

  • Form 423 Certification of Financial Management or Certificate of Financial Management Course (individual)
  • Local Form 4004-1(A)(11) Chapter 11 Certification of Compliance and Motion for Entry of Discharge (individual)
