UNCLAIMED FUNDS

Unclaimed funds are funds held by the Court for an owner or recipient who is entitled to money, but who has not claimed ownership. Most unclaimed funds arise when dividends (assets) are distributed by the case trustee to creditors pursuant to settlement of a bankruptcy case, but the property goes unclaimed. Unclaimed funds may arise out of a trustee being provided with incomplete or outdated address information for the recipient. Any party desiring to retrieve unclaimed funds may do so by following the directions contained in the Instructions document and filing the forms listed here:

The following information must be provided in support of the application: copy of a valid government-issued photo ID of the party entitled to the funds and proof of notice to the debtor and debtor's counsel, if any, trustee, United States Trustee, United States Attorney for the Eastern District of Oklahoma, and the original claimant and claimant's counsel, if any, if the applicant is not the original creditor or claimant pursuant to Local Rule 3011-1(B). The Court will not accept any documents which appear to have been altered in any material way. Documentation should include original signatures and should not be on facsimile paper. Additional documentation may be required under certain circumstances (eg., original creditor has merged with another entity, etc.).

RULE 3011-1.     UNCLAIMED FUNDS

A.Disposition of Unclaimed Funds. A request by any proper entity for the release of unclaimed funds pursuant to 28 U.S.C. § 2042 shall be made by completing and filing an Application for Payment of Unclaimed Funds on Local Form 1340 Application for Payment of Unclaimed Funds. An applicant shall file separate supporting documentation to establish the identity of the claimant and the authority of the applicant to make the claim according to the Instructions for Filing Application for Payment of Unclaimed Funds by filing Local Form 1340A Supporting Documentation for Application for Payment of Unclaimed Funds. A claimant entitled to such funds may obtain an order directing payment to the claimant upon full proof of the right to payment of such funds. If no response or objection has been filed within fourteen (14) days from the date of filing of the application the Court may set a hearing and/or require additional evidence before ruling on the application and directing payment of such funds. All indications of fraud will be referred to the United States Attorney for the Eastern District of Oklahoma.

B.Notice Required. Such application shall be served by the claimant on the debtor and debtor’s counsel, if any, trustee, United States Trustee, United States Attorney for the Eastern District of Oklahoma, and the original claimant and claimant’s counsel, if any, if the applicant is not the original creditor or claimant.
