Amendments: Schedules, Matrix, Creditors

Please note these key points.

∙ Amended Creditor Lists are not allowed per Local Rule 1009-1.  The Debtor must file an Amendment to the matrix that includes only the new creditors, a verification by the Debtor, an Amendment fee if adding new creditors, (See the Fee Schedule for the Amendment Fee), and a Certificate of Mailing of the Notice of 341 meeting with all bar dates and deadlines.  The Attorney should also add the new creditors to creditor maintenance.  If creditors are being deleted, the Debtor must file a list of creditors to be deleted along with proper verification and a statement that the creditors are to be deleted by the court.   Upon receipt, the Court will delete the named creditors from the court database.

∙ An Amendment fee is charged to add creditors, delete creditors, change the amount of a debt, change the classification of a debt on the Schedules or each time an Amendment to the List of Creditors is filed to add or delete a creditor.

∙ No Amendment Fee is charged when the Amendment to the Schedule or Matrix is to change the address of a creditor listed on the original Schedule or Matrix or the addition of an Attorney for a creditor  listed on the original Schedule or Matrix.

∙ No Amendment fee is charged when the debtor files an Amendment to the Schedules of post-petition debts in Chapter 13 cases that has converted to a Chapter 7 case.

∙ No Amendment fee is charged when a joint case divides and the debtor amends the schedules or the matrix due to the division of the case splitting.
