Motion for Summary Judgment and Motion for Default Judgment

Motions for Summary Judgment Per Local Rule 7056-1:

  • Motions for Summary Judgment do not require a Form 20 Notice
  • Motions for Summary Judgment do require a Brief in support.
  • After the Motion is filed, the Court will set a 14 day deadline for the filing of a Response Brief
  • Once a Response is filed, the Court will set a 14 day deadline for the filing of a Reply
  • Once the Reply deadline expires, the documents will be sent to the Judge’s chambers.
  • Unless a hearing is requested by a party, a hearing shall be deemed waived.

 

How to file a Motion for Summary Judgment:

1.   Select Adversary

2.   Select Motions

3.   Message displays NOTE: Enter an Adversary Case Number.

4.   Type correct adversary case number to match the document you are filing.

5.   Select Document Event: Summary Judgment.

6.   Check if joint filing with other atty only if another attorney has signed the document if not, select next.

7.   Select Party Filer. Party filer not listed, Add/Create New Party.

8.   Browse, VERIFY and attach the Motion (pdf file.) Attach supporting documents, if applicable.

9.   Check the appropriate box regarding your Certificate of Service.

10.  Modify text, if applicable, such as: Title of document and/or Pertinent information - names, titles, property, etc.

11.  Warning!! Verify filing entry is correct before submitting the "Final Docket Text."

12.  Save the Notice of Electronic Filing.

 

Motion for Default Judgment

  • Once a party is in default and a Request for Entry of Default by the Clerk has been filed, a default judgment pursuant to Rule 55(b) of the Federal Rules of Civil Procedure may be requested by filing a Motion for Default with a Notice of Motion Form 20A.

 

How to file a Motion for Default Judgment:

1.   Select Adversary

2.   Select Motions

3.   Message displays NOTE: Enter an Adversary Case Number

4.   Type correct adversary case number to match the document you are filing

5.   Select Document Event: Default Judgment.

6.   Check if joint filing with other attorney only if another attorney has signed the document if not, select next.

7.   Select Party Filer. Party filer not listed, Add/Create New Party.

8.   Browse, VERIFY and attach the Motion (pdf file.) Attach supporting documents, if applicable

9.   Message displays NEXT docket a Notice of Motion/Hearing Set using Form 20A

10. Check the appropriate box regarding your Certificate of Service.

11.  Modify text, if applicable, such as: Title of document and/or Pertinent information - names, titles, property, etc.

12.  Warning!! Verify filing entry is correct before submitting the "Final Docket Text."

13.  Save the Notice of Electronic Filing.
